The terms and conditions that govern your use of the Smith HVAC Pros website and your engagement with us.

- These Terms are the agreement between you and Smith HVAC Pros for using this website and engaging us for HVAC and sheet-metal work.
- Estimates and quotes are non-binding until both sides sign a written service agreement.
- Some website content is created with the help of AI and automation. It is general information only — not professional advice, and it may not be perfect.
- Site content is provided "as is." Our liability is limited, and you agree to resolve most disputes through binding individual arbitration (you can opt out within 30 days) under Illinois law, in Randolph County, Illinois.
- Daikin's 12-year warranty and Comfort Promise are manufacturer terms offered through Daikin — they are not warranties from this website.

1. Acceptance of These Terms
These Terms of Service ("Terms") form a binding agreement between you and Smith Heating, Air, & Sheet Metal LLC, doing business as "Smith HVAC Pros" ("Smith HVAC Pros," "we," "us," or "our"). They govern your use of our website at smithhvacpros.com (the "Site") and your engagement with us for products and services.
By accessing or using the Site, requesting an estimate, or engaging us for service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site or request service. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Our Services
Smith HVAC Pros provides residential and light-commercial heating, ventilation, and air-conditioning (HVAC) services, including system installation and replacement, repair and service, preventive maintenance, indoor-air-quality solutions, ductless and geothermal systems, and in-house custom sheet-metal fabrication and ductwork.
We serve customers in our local service area, which includes Randolph County, Illinois and the surrounding region, and Perry County, Missouri. Service availability may depend on your location, scheduling, and the nature of the work.
Descriptions of services on the Site are general in nature. The specific scope, materials, pricing, and terms for any work will be set out in the written estimate or service agreement we provide for your project.

This Site is built and maintained using CI Web Group's "Hydra" platform, and some of its content, descriptions, and automated features are generated or assisted by artificial intelligence and automation tools.
AI-assisted and automated content is provided for general informational purposes only. It may be incomplete, outdated, or inaccurate, and it does not constitute professional, engineering, safety, or legal advice. While we review our content and a human oversees it, we do not guarantee that AI-assisted or automated outputs are error-free. 5. Estimates, Quotes & Non-Binding Nature
Any prices, estimates, quotes, or proposals presented on the Site or provided informally (by phone, email, or text) are non-binding and for planning purposes only. They are based on the information available at the time and may change after an on-site evaluation.
No estimate or quote is a contract. A binding agreement is formed only when you and Smith HVAC Pros enter into a written service agreement or work order signed (including electronically) by both parties. Until then, either party may decline to proceed.
6. No Professional Advice
Content on the Site is provided for general informational purposes and is not a substitute for a professional, on-site assessment by a qualified technician. Heating and cooling systems involve electrical, combustion, and refrigerant hazards; do not attempt repairs based on Site content. We are not liable for actions you take based solely on information on the Site.
7. Intellectual Property & Limited License
The Site and its content — including text, graphics, logos, images, page layouts, and the Smith HVAC Pros and Smith Heating, Air, & Sheet Metal names and marks — are owned by us or our licensors and are protected by intellectual-property laws. Third-party marks (such as Daikin and GoodLeap) belong to their respective owners.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial use in evaluating and obtaining our services. You may not copy, reproduce, republish, scrape, frame, or create derivative works from the Site without our prior written permission.
8. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose;
- Submit false, misleading, or another person's information without authorization;

We handle the information you submit as described in our Privacy Policy.
10. Third-Party Services & Links
The Site uses and links to third-party services, including Google Maps and Google reCAPTCHA, and — when it becomes available — financing through our partner GoodLeap. Your use of those services is governed by the third party's own terms and privacy policies. We do not control and are not responsible for third-party services, content, or websites, and a link does not imply our endorsement.
11. Manufacturer Warranties (Daikin)
We are proud to install Daikin equipment, and qualifying new Daikin systems we install may come with Daikin's 12-year worry-free limited warranty and Daikin's Comfort Promise. These are manufacturer and program terms offered by Daikin (and, where applicable, through our authorized-dealer relationship) — not warranties created by this Site.
Eligibility, coverage, registration requirements, and exclusions are governed by Daikin's official warranty documents and program rules, which control in the event of any conflict with summaries on the Site. We will provide the applicable warranty terms for your installation, and any workmanship guarantee we offer will be stated in your written service agreement. Nothing in the "AS IS" disclaimer below limits these separate manufacturer or written workmanship warranties.
12. Disclaimer of Warranties
Except for (a) any express warranty stated in a signed written service agreement and (b) applicable manufacturer warranties described above, the Site and its content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is accurate, complete, or current.
13. Limitation of Liability
To the fullest extent permitted by law, in no event will Smith HVAC Pros or its owners, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of (or inability to use) the Site — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site and these Terms will not exceed one hundred U.S. dollars (US$100.00). This limitation does not apply to your obligation to pay for services rendered, and it does not limit any liability that cannot be limited under applicable law (including liability for gross negligence, willful misconduct, or personal injury caused by our negligence). Your rights and our obligations for any services you purchase are governed by your written service agreement, not by this Site limitation.
14. Indemnification
You agree to defend, indemnify, and hold harmless Smith HVAC Pros and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Pricing, Billing & Financing
Pricing for services is provided in your estimate or written service agreement and is subject to the terms there. We do not collect payments or capture credit-card information on this Site. Any payment for services is arranged directly with us through our normal business channels.
We expect to offer financing through our partner GoodLeap in the future; this option is coming soon and is not yet available. If and when financing becomes available, it will be provided by GoodLeap or another third-party lender, subject to that lender's separate application, approval, terms, and privacy practices. Smith HVAC Pros does not make credit decisions or lend money.
16. Governing Law & Venue
These Terms, and any dispute arising out of or relating to them or the Site, are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree that the exclusive venue for any permitted court action will be the state or federal courts located in or serving Randolph County, Illinois, and you consent to the personal jurisdiction of those courts.
17. Binding Arbitration & Class-Action Waiver

Please read this section carefully — it affects how disputes are resolved and limits your right to sue in court or participate in a class action.
Except for (a) qualifying small-claims-court matters and (b) claims to enforce or protect intellectual-property rights, you and Smith HVAC Pros agree that any dispute, claim, or controversy arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in or near Randolph County, Illinois, or by remote means, and judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and Smith HVAC Pros agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.
30-day right to opt out. You may opt out of this arbitration agreement by sending written notice to [email protected] or 12100 Wine Hill Rd., Steeleville, IL 62288 within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, the Governing Law & Venue section above will apply. Opting out will not affect any other part of these Terms.
This arbitration provision applies to disputes about the Site and these Terms. Disputes about services you purchase are governed by your written service agreement, which may contain its own dispute-resolution terms.
18. Informal Dispute Resolution First
Before starting an arbitration or court action, you agree to first contact us at [email protected] or (618) 965-2665 and give us a reasonable opportunity (at least 30 days) to resolve the matter informally. Most concerns can be resolved quickly this way.
19. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or for any other reason. The provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and arbitration — will survive.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court, but the rest of the arbitration agreement will still apply.
21. Entire Agreement
These Terms, together with our Privacy Policy and any written service agreement between us, constitute the entire agreement between you and Smith HVAC Pros regarding the Site, and supersede any prior understandings on that subject. Our failure to enforce any provision is not a waiver of it.
22. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Changes are effective when posted, and your continued use of the Site means you accept the updated Terms.
