Your privacy matters to us

How Smith HVAC Pros collects, uses, and protects information when you use our site and services.

The short version

  • We collect the details you send through our contact and estimate forms — your name, phone number, email, and message — plus basic technical data your browser shares automatically.
  • We use that information to respond to you, schedule and provide HVAC service, and keep the Site working and secure.
  • We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California law.
  • Our forms are protected by Google reCAPTCHA and our pages include a Google Maps location embed — both set Google cookies. We do not currently run Google Analytics, advertising pixels, or other marketing trackers.
  • You can ask us to access, correct, or delete the information we hold about you; California residents have additional rights described below.

1. Who We Are & What This Policy Covers

Smith Heating, Air, & Sheet Metal LLC, which does business as "Smith HVAC Pros" ("Smith HVAC Pros," "we," "us," or "our"), respects your privacy. This Privacy Policy explains what information we collect through our website at smithhvacpros.com (the "Site"), how we use and protect it, and the choices you have.

It applies to the Site and to the heating, cooling, and sheet-metal services we provide to homeowners and small businesses across our service area in Illinois and Missouri. It does not apply to third-party websites or services we link to.

By using the Site or contacting us through it, you agree to the practices described in this Policy. If you do not agree, please do not use the Site.

2. Information We Collect

Information you give us

When you complete a contact, service-request, or free-estimate form, or otherwise reach out to us, we collect the information you choose to provide. This typically includes:

  • Identifiers and contact details — your name, phone number, email address, and (if you provide it) your service address or city;
  • The contents of your message — the HVAC need you describe, the service or topic you select, and any file you choose to attach;
  • Communication records — notes from phone calls, texts, or emails when you contact us directly.

Information collected automatically

Like most websites, our hosting and security providers automatically log limited technical information when you visit, such as your IP address, browser type and settings, device and operating-system information, the pages you view, and the date and time of your visit. This data helps us keep the Site secure and working properly.

Cookies and similar technologies

The Site itself uses only the cookies and local storage needed for it to function and stay secure. Third-party features we embed — Google Maps (which shows our location) and Google reCAPTCHA (which protects our forms from spam and abuse) — set their own Google cookies when those features load. See "Cookies, Analytics & Tracking" below for details and your choices.

3. Where Your Information Comes From

We collect personal information directly from you (for example, when you submit a form or call, text, or email us), automatically from your device and browser as you use the Site, and from the service providers that help us operate the Site and respond to your inquiries (for example, our website host and our lead-delivery provider).

4. How We Use Your Information

We use the information we collect to:

  • Respond to your questions and requests, and follow up about service or estimates;
  • Schedule, perform, and support the HVAC and sheet-metal services you ask us about;
  • Operate, maintain, secure, and improve the Site, including protecting our forms against spam and fraud;
  • Send you service-related communications, such as appointment confirmations or replies to your inquiry;
  • Keep business records and comply with our legal, tax, and contractual obligations;
  • Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity.

We do not use the information you provide to make decisions that produce legal or similarly significant effects about you through solely automated processing.

5. How We Disclose Your Information

We are a local, owner-operated business. We do not sell your personal information. We disclose personal information only in the limited circumstances below, and only to the extent needed:

  • Service providers (processors). We share information with vendors who perform services for us under contract and may use the information only on our behalf. These include: (1) website hosting and content-delivery providers that store and serve the Site; (2) our lead-delivery and customer-relationship provider — CI Web Group — which operates the form relay that routes your form submission to us and notifies us at our business email; and (3) Google, for the Maps location embed and the reCAPTCHA form-protection service.
  • Professional advisors and legal compliance. We may disclose information to our accountants, attorneys, or insurers, or when we believe in good faith that disclosure is required by law, subpoena, or other legal process, or is necessary to protect our rights, your safety, or the safety of others.
  • Business transfers. If we are ever involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction; we will require the recipient to honor this Policy.
  • With your direction. We may share information when you ask us to or otherwise consent.

We do not disclose your personal information to third parties for their own marketing purposes.

6. Do We "Sell" or "Share" Your Personal Information?

No. We do not sell your personal information for money or other valuable consideration, and we do not "share" your personal information for cross-context behavioral (targeted) advertising, as those terms are defined under the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"). We have not sold or shared personal information in the preceding twelve (12) months, including information about consumers under 16 years of age.

7. Text Messaging (SMS) & Calls

[Confirm]Does Smith HVAC Pros send marketing or promotional texts/calls? Default assumption: NO. The Site does not currently collect SMS marketing consent, and we do not send marketing texts. The terms below are drafted and ready to enable — if Smith begins sending marketing or automated texts/calls, turn on the on-form consent checkbox and activate this section.

Today, we contact you only in response to a request you make — for example, returning your call or replying to your inquiry — using the phone number or email you give us. We do not currently send marketing or promotional text messages, and our website forms do not enroll you in any texting program.

If we later offer text-message updates, the following terms will apply, and we will obtain your express written consent through a clearly labeled, unchecked opt-in before sending any such messages:

  • Consent is express and optional. You will affirmatively opt in, and consent to receive marketing texts will never be a condition of purchasing any product or service.
  • Message frequency varies depending on your interaction with us.
  • Message and data rates may apply, depending on your mobile plan and carrier.
  • To stop messages, reply STOP at any time; for help, reply HELP, or contact us at the phone or email below. We will honor opt-out requests promptly.
  • Carriers are not liable for delayed or undelivered messages.
  • We will not share your mobile opt-in information or consent with third parties for their own marketing.

8. Cookies, Analytics & Tracking Technologies

Our own Site relies only on essential cookies and local storage needed for it to function and stay secure. Beyond those, cookies are set by the third-party Google features we embed:

  • Google Maps — used to display our business location; loading the map sets Google cookies and shares limited request data with Google.
  • Google reCAPTCHA (Enterprise) — used to protect our forms from spam and abuse; it loads when you submit a form and sets Google cookies. Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.
  • Web fonts — we load the Archivo typeface from Google Fonts, which involves a request to Google's font servers.

Analytics and advertising. We do not currently use Google Analytics, Google Tag Manager, the Meta (Facebook) pixel, or other marketing-analytics or advertising trackers on the Site. If we add any in the future, we will update this Policy and, where required, request your consent before non-essential tracking technologies load.

Your choices — Do Not Track & Global Privacy Control. You can usually refuse or delete cookies through your browser settings, though some Site features may not work as well. Because there is no common industry standard for "Do Not Track" (DNT) signals, our Site does not respond to them. Where required by law, we treat a recognized Global Privacy Control (GPC) opt-out preference signal from California residents as a valid request to opt out of any "sale" or "sharing" of personal information — though, as noted above, we do not sell or share personal information.

9. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information, subject to legal limits and exceptions:

  • Know / access the categories and specific pieces of personal information we have collected about you;
  • Delete personal information we have collected from you;
  • Correct inaccurate personal information;
  • Opt out of any "sale" or "sharing" of personal information (note: we do neither);
  • Non-discrimination — we will not deny service, charge a different price, or provide a different quality of service because you exercised your privacy rights.

California residents (CCPA/CPRA)

If you are a California resident, you have the access, deletion, correction, and opt-out rights described above, plus the right to limit the use of sensitive personal information (we do not use sensitive personal information for purposes that would trigger this right). You may make up to two free access/deletion requests in a 12-month period and may use an authorized agent to submit requests on your behalf. We will not discriminate against you for exercising these rights.

Illinois and Missouri residents

Illinois and Missouri — the states where we operate and serve customers — do not currently have a comprehensive consumer-data-privacy statute comparable to California's. Even so, we extend the core rights above (access, correction, and deletion) to all of our customers as a matter of practice, and we comply with applicable Illinois and Missouri laws governing the protection and secure disposal of personal information.

Illinois Biometric Information Privacy Act (BIPA). We do not collect, capture, or store biometric identifiers or biometric information (such as fingerprints, face geometry, or voiceprints) through this Site, so BIPA does not apply to our website operations.

10. How to Exercise Your Rights

To make a privacy request, contact us by email at [email protected] or by phone at (618) 965-2665. Please include enough detail for us to understand and respond to your request. We will take reasonable steps to verify your identity before acting — typically by confirming information we already have on file — and we will respond within the timeframes required by applicable law (for California requests, generally within 45 days, with one permitted extension where allowed).

11. Children's Privacy

Our Site and services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, please contact us and we will delete it. This is consistent with the federal Children's Online Privacy Protection Act (COPPA).

12. How Long We Keep Your Information

We keep personal information only as long as needed for the purposes described in this Policy. In general, we retain inquiry and lead information for up to twenty-four (24) months after our last contact with you, and we retain records related to completed jobs, invoices, warranties, and legal or tax obligations for as long as those obligations require. When information is no longer needed, we take reasonable steps to securely delete or de-identify it.

13. How We Protect Your Information

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, or disclosure — for example, encrypted (HTTPS) transmission of our web pages and form submissions, reputable hosting, and access controls. However, no website, internet transmission, or method of electronic storage is completely secure. We cannot and do not guarantee absolute security, and any information you provide is at your own risk.

The Site may link to or embed third-party websites and services (for example, Google Maps, Google reCAPTCHA, our equipment manufacturer Daikin, and — when it becomes available — our financing partner GoodLeap). We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policy of any third-party site or service you use.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we do, we will revise the "Last updated" date at the top of this page, and material changes will be reflected here. Your continued use of the Site after an update means you accept the revised Policy.
